USCIS Adjustment of Status Filing Date Issue

USCIS has determined that employment based adjustment of status application filings in December 2015 may only use the Application Final Action Dates chart in the Department of State Visa Bulletin for December 2015.

This chart only allows applicants with a priority date of 12/13/2013 or before to file for adjustment of status. Applicants who are filing for adjustment of status in November based on approved EB-5 petitions can still use the Dates for Filing Employment Based Visa Applications chart for November 2015. This chart allows applicants with a priority date of 05/01/2015 or before to file for adjustment of status.

I.A. Donoso & Associates will monitor the USCIS website for possible changes in Adjustment of Status filing dates based on the upcoming January 2016 visa bulletin. Visit http://www.uscis.gov/visabulletininfo for information on whether USCIS has determined that the Dates for Filing Employment Based Visa Applications chart can be used for the current month for filing applications for adjustment of status with USCIS.
