The EB-5 visa program has an annual maximum of approximately 10,000 new visas issued per year. At least 3,000 of these visas are reserved for new I-526 visa petitions filed based on investments in projects sponsored by a Regional Center. The USCIS has stated that up to the full 10,000 allotted visa slots may be used for Regional Center based visas if not used for Standard Program EB-5 visas.
At present, EB-5 investors born in mainland China are the only persons who are subject to a waiting list for EB-5 visas. Observers estimate that the EB-5 waiting list for mainland China investors is approximately 5 years at present, and could grow longer if the popularity of the EB-5 program in mainland China continues. Investors born in any other country except for mainland China are not subject to a waiting list for an EB-5 visa. The impact of a waiting list causes EB-5 investors from mainland China to have to wait to obtain their EB-5 visa after the Form I-526 visa petition is approved.
