如果绿卡申请人身在美国境外,唯一移民美国的方式就是通过美国使领馆面试程序获取移民签证。但是,如果绿卡申请人已经在美国境内 (工作,观光或学习),既可以通过在美国境内申请I-485调整为绿卡身份,也可以通过使领馆面试程序申请移民签证。虽然两种方式的最终目的都是拿绿卡,在做出申请决定之前,最好根据个案全面评估,避免不利结果。 什么是美国使领馆面试程序? 当美国的赞助人- 亲属移民的美国亲属或职业移民美国的雇主,递交赞助绿卡申请人的申请到移民局并成功获批后,绿卡申请人被要求在美国驻申请人母国的使领馆参加移民签证面试。以中国内地为例,所有移民签证的面试地点均为美国驻广州领事馆。 在预约面试之前,申请人根据移民法规要求,向美国签证中心(“National Visa Center”or “NVC”)递交所需签证申请表(DS-260)和支持性文件。依据签证类别,支持性文件不相同。职业移民的文件较为简单,例如出生证明,结婚证明,无犯罪记录证明。亲属移民的申请人除了职业移民提交的文件,还需提供美国亲属作为赞助人所签署的“经济担保” I-864表格和证明赞助人收入和财产文件,以证明赞助人的经济能力,使得绿卡申请人不会在移民美国后成为美国政府的经济负担。美国签证中心NVC完成文件审阅后,会为绿卡申请人在当地美国使领馆预约签证面谈。面谈通过,签发有效期为6个月的移民签证,申请人必须在6个月内是使用移民签证登陆美国。登陆后的几个月内收到绿卡。 什么是I-485调整身份申请? 当绿卡申请人已经有一个合法的非移民身份在美国逗留时,为了继续逗留美国,可以在排期到后在美国境内直接递交I-485申请,调整非移民类身份为绿卡身份,避免回到母国申请移民签证。适用I-485申请的人群包括持有F-1签证的学生,持有各类非移民工作签证的雇员,或者持有B签证在美国旅游观光的游客。需要注意的是,F和B签证的申请人必须在入境美国90天后递交I-485申请,因为这两种签证在移民法中不是“双重目的” (duel intent)的签证,唯一入境美国的目的是学习或旅游观光。 两种途径的常见的问题: I-485 调整身份申请和美国使领馆面试程序是获得绿卡最后的 一个步骤。对于两种方式的选择,要根据个案情况,选择适合自己的途径。下面我们讨论下选择过程中常见的问题: 我是持有F-1签证的留学生,但是即将毕业,可以递交I-485吗? 可以。无论您是否申请OPT,毕业后或OPT到期的90天grace period内,都是合法的学生身份,允许递交I-485转换身份。在I-485递交时,可以同时递交I-765工卡和I-131回美证,使您在等待I-485获批的一段时间有工卡和回美证在美国工作和短期出国旅行。工卡和回美证在同时申请的情况下,移民局会将两个证件制作在一张卡上(combo card)。 递交I-485后可以出国旅行吗? 拿到移民局制作的combo card后是可以出国旅行的。值得注意的是,大部分情况下,在combo card没有获批时,申请人离境美国会导致I-485申请作废。例外:持有H或L签证的申请人,I-131批准前离开美国不会导致I-485失效。但是,在做出旅行计划时或申请I-485之前已经有旅行计划的申请人请咨询移民律师再做决定。 我想在美国递交I-485,不想在母国面签,可以飞到美国后递交I-485吗? 可以。但是取决于签证类型。例如,申请人持有, L或O签证入境美国,可以立即递交I-485。但是F或B签证,则等待90天后才能递交。 我已经递交了文件到美国签证中心等待面签通知,但是拿到了美国的工作offer或学校的offer,需要马上赴美,可以到美国后在等待面签同时,递交I-485吗? 可以。虽然选择了使领馆面签程序,但是并不阻止申请人抵达美国后递交I-485。如上题,取决于签证类型,是否存在90天限制。如果I-485递交后NVC安排了面试时间,申请人可以选择回到母国面试,或者在美国等待I-485获批。 我已经递交了I-485,由于国内家人或工作的原因,需要我回国,可以转成使领馆程序吗? 可以。如果没有选择使领馆程序,而最终希望在母国申请移民签证,这是申请人必须递交I-824表格要求移民局将批准的申请转案到NVC,在NVC收到移民局的转案后,开始使领馆程序。对于已经递交的I-485,申请人向移民局递交撤销I-485申请即可。 我选择了使领馆程序并收到了面试通知,目前身在美国,可以在美国做体检并将美国的体检报告递交使领馆吗? 不可以。体检必须要在面试国家当地指定的医院。同理,在美国递交I-485的体检报告,必须在移民局指定的美国诊所。 Donoso & Partners, a leading immigration law firm based in Washington, D.C., will continue to report on developments regarding the […]
