The investor must generally be at least 18 years old and be competent to manage their own affairs.  The Investor’s immediate family, comprised of their spouse and unmarried children under age 21, will be part of the family group that is allowed to immigrate to the U.S. together with the principal applicant investor. 

USCIS has complex rules under the Child Status Protection Act regarding the age of children in reference to potential visa waiting lists.  Donoso & Partners has developed deep expertise in connection with the Child Status Protection Act, which we have used to advise clients early in their visa process with the goal of keeping families together as they complete the EB-5 process.
