11 Sep EB5 Final Action Dates Jump in October 2024
Washington, DC, September 11, 2024: The Department of State and National Visa Center (NVC) released the October Visa Bulletin today, and it brought some welcome news for EB-5 investors.
The Final Action Dates (Chart A) for EB-5 Unreserved India jumped forward to January 1, 2022 (up from December 1, 2020 in September 2024). This means that all EB-5 investors under the original EB-5 program can expect to receive appointments for US green card at Consulates during 2024-2025. Additionally, EB-5 investors under the original EB-5 program can file Form I-485 Adjustment of Status (with its work permit and travel permit options) starting on October 1, 2024, so long as they filed their I-526 visa petition before January 1, 2022.
Similarly, Final Action Dates (Chart A) for EB-5 Unreserved China moved forward to July 15, 2016 (up from December 15, 2015 in September 2024). Again, this opens up appointment slots at US Consulates and the opportunity for filing I-485 Adjustment of Status for hundreds of EB-5 investors.
All of the EB-5 Reserved Categories remain current and available. Reserve Categories apply to EB-5 investors who filed their visa petitions under the new EB-5 program, which started in March of 2022.
Finally, as of today, USCIS has not updated its website to indicate whether it will accept Dates for Filing (Chart B) regarding EB-5 investors under the original EB-5 program.
