DOS has released the Visa Bulletin for April 2016. For EB-5 visas, both regional center and direct investments, the Final Action Priority Date for persons born in mainland China has now been set to February 1, 2014.
The Filing Priority Date for persons born in mainland China has now been set to May 1, 2015. USCIS has not yet stated whether they will be using the Final Action Priority Date or the Filing Priority Date for Adjustment of Status Applications for April 2016. The most recent estimated number of unused EB-5 visas available for persons born in mainland China is estimated to be approximately 7,975 for the fiscal year.
Currently, this means that persons born in mainland Chinese who filed their visas up to February 1, 2014 can file for Adjustment of Status in April 2016. Persons born in mainland Chinese who filed their visas up to May 1, 2015 can complete Consular Processing in April 2016.
If USCIS determines that the Filing Priority Dates shall be used instead of the Final Action Priority date, then persons born in mainland Chinese who filed their visas up to May 1, 2015 can also file for Adjustment of Status in April 2016.
NVC’s New EB-5 Investor Assistance Desk
DOS has announced the new NVC’s EB-5 Investor Assistance Desk, as part of NVC’s effort to improve customer service. Individuals with questions related to an approved I-526 petition should correspond with the Investor Assistance Desk at the dedicated email address: NVCeb5@state.gov. The email may also be used to send derivative relationship documents, inquiries on derivatives, the Child Status Protection Act, and general case status.
